This Temporary Employment Contract (the “Contract” or “Temporary Employment Contract”) states the terms and conditions that govern the contractual agreement between [Sender.Company], having its principal place of business at [Sender.StreetAddress][Sender.City][Sender.State][Sender.PostalCode] (the “Company”), and [Employee.FirstName][Employee.LastName] (the “Temp”), who agrees to be bound by this Contract.

WHEREAS, the Company is engaged in the Description of business; and

WHEREAS, the Company desires to employ and retain the services of the Temp on a temporary basis according to the terms and conditions herein.

NOW, THEREFORE, In consideration of the mutual covenants and promises made by the parties hereto, the Company and the Temp (individually, each a “Party” and collectively, the “Parties”) covenant and agree as follows:

1. TERM.

The term of this Temporary Employment Contract shall commence on Start Date and continue Time Frame.

2. TERMINATION.

The Temp agrees and acknowledges that, just as they have the right to terminate their employment with the Company at any time for any reason, the Company has the same right, and may terminate their employment with the Company at any time for any reason. Either Party may terminate said employment with written notice to the other Party.

3. DUTIES.

The Company shall employ the Temp as Position title (the “Position”). The Temp accepts employment with the Company on the terms and conditions set forth in this Temporary Employment Contract, and agrees to devote his full time and attention (reasonable periods of illness excepted) to the performance of his duties under this Agreement. In general, the Temp shall perform all the duties as described on Exhibit A attached hereto.

4. HOURS OF WORK.

The Temp’s hours of work shall be day of week to day of week at hours determined by the employer provided that ordinary working hours shall not exceed amount hours per week.

5. COMPENSATION. 

In consideration for the performance of the duties hereunder, the Temp shall be entitled to compensation as described on Exhibit B attached hereto.

6. RETURN OF PROPERTY.

Within Seven (7) days of the termination of this Temporary Employment Contract, whether by expiration or otherwise, the Temp agrees to return to the Company, all products, samples, or models, and all documents, retaining no copies or notes, relating to the Company’s business including, but not limited to, list of items obtained by the Temp during its representation of the Company.

7. COMPANY PROCEDURES.

The Temp agrees and acknowledges that he or she shall comply with the Company’s established disciplinary code as well as any other rules, policies, and procedures that may be introduced from time to time. Copies of such documents are available upon request.

8. NO MODIFICATION UNLESS IN WRITING.

No modification of this Agreement shall be valid unless in writing and agreed upon by both Parties.

9. APPLICABLE LAW.

This Temporary Employment Contract and the interpretation of its terms shall be governed by and construed in accordance with the laws of the State of [Sender.State] and subject to the exclusive jurisdiction of the federal and state courts located in [Sender.Country], [Sender.State].

10. COMPENSATION TO TEMP AGENCY.

[Sender.Company] agrees that it will bear all costs that are required for hiring the Temp, including, but not limited to, the percentage of the fee that it will pay the Temp agency since the Temp has been hired. Due to this provision, the Temp has been requested not to compensate the Temp agency with any percentage or cut from their salary.

11. REASONABLE EFFORT.

The Temp agrees to put in reasonable effort to present the best image of [Sender.Company] in front of all its stakeholders. For the same, they have to act and dress in a certain way, keeping the code of conduct in the office strictly professional.

They also agree to take reasonable effort to complete all tasks presented to them at a steady pace. We expect that all tasks delivered to the Temp for completion have satisfactory outcomes.

Failing to continually produce work that meets the standards of [Sender.Company], or failing to keep up [Sender.Company]’s professional code of conduct, may result in either a written or verbal notice. Failing to adhere to these notices may result in contract termination.

12. NON-SOLICITATION.

The Temp agrees not to reach out to any of [Sender.Company]’s clients, directly or indirectly, unless otherwise required for the purpose of [Sender.Company]’s work, or if the Temp has written permission from [Sender.Company]. The Temp agrees not to solicit or poach any employees, clients, laborers, or any of [Sender.Company]’s stakeholders, either for themselves or for a third party. If they are caught breaching this policy, they will be liable to pay a penalty of $ (insert amount).

13. CONFIDENTIALITY.

The Temp agrees to maintain strict confidentiality for all the sensitive information discussed about [Sender.Company] while they are in employment with [Sender.Company]. Confidential information does not refer to information that is readily available to the public, but is rather sought out during the course of employment. Confidential information includes, but is not limited to, information on [Sender.Company]’s systems, processes, trade secrets, future strategies, projections, inside knowledge, etc., whether discussed on record or off the record.

14. NON-COMPETE.

[Sender.Company] agrees not to tie in the The Temp with any non-compete or conflict of interest clauses.

15. INSURANCE AND REMEDIES.

[Sender.Company] assures the Temp that they have been covered for health insurance as per their rights. The health insurance details are provided in Exhibit C — this is the same insurance policy that has been received by other members and employees of [Sender.Company].

In case the Temp incurs any liabilities or damages doing the work as prescribed by [Sender.Company], or [Sender.Company]’s representatives, the Temp will be compensated for the liabilities and damages. However, if these damages are not due to a fault of [Sender.Company], then the Temp will incur all costs at their own expense.

16. SEVERABILITY.

In case any part of the contract is found to be untrue or not legally valid or enforceable, either in part or whole, then the remaining parts of this contract will still remain perfectly and legally valid, as if there were no issues in the contract.

17. DISPUTES AND RESOLUTIONS.

In case of any disputes arising amongst both Parties, they are to amicably resolve the issue, outside of courts, preferably with the help of an unbiased third party such as an agent. If the settlement amount is not agreed upon by either/both Parties, or if the settlement terms are not agreed upon, they may then approach the court residing in [Sender.Country], [Sender.State], where applicable laws will come into motion. The decision arising from the court will be considered final, unless the Parties and the dispute arrives at a court of a higher standing.

IN WITNESS WHEREOF, each of the Parties has executed this Temporary Employment Contract, both Parties by its duly authorized officer, as of the day and year set forth below.

1. COMPENSATION

The Temp shall be entitled to receive an hourly rate of dollar amount per week or month (the “Compensation”) for performance of the duties described in this Agreement for the term of the Agreement.

2. TIMING OF PAYMENTS

Compensation shall be paid by the Company every pay period (the “Pay Period”) within (X) number of days from the end of the Pay Period for which the Compensation is to be paid..

3. NO OTHER COMPENSATION

The compensation set out above shall be the Temp’s sole compensation under this Agreement.

4. TAXES

Payments to the Temp shall be subject to employer withholding.

Exhibit C

Include health insurance details the Temp will receive once they sign the contract.
