PandaTip: Telecommuting has unique issues that standard employment agreements don’t address. This template can be used in addition to an existing agreement when an employee will be allowed to telecommute for a period of time.
This telecommuting agreement will be entered into on [Agreement.CreatedDate] between [Sender.FirstName] [Sender.LastName] (Employer) and [Employee.FirstName] [Employee.LastName] (Employee) collectively known as the “Parties”.
Terms and Conditions
Whereas the Employer wishes to retain the Employee as a valued team member, AND
The Employee’s job duties may be performed from any location with a working phone, computer, and internet connection, AND
The Employee qualifies for the Employer’s telecommuting program,
The Employer and Employee agree to enter into this telecommuting agreement in accordance with the following terms:
This telecommuting agreement shall be in effect as of [Agreement.CreatedDate] and shall continue until [Agreement.EndDate] unless otherwise cancelled in accordance with the terms of this agreement.
PandaTip: Most companies require remote employees to be on-task during business hours. This section of the template allows you to define when you expect a telecommuting employee to be “at work”.
Employee agrees to be logged into work systems and be on-task between the hours of 8:00am and 5:00pm on business days, with the following exceptions:
The Employee may take two 15 minute breaks and one 1 hour lunch break each day.
The following holidays are not considered business days:
- Thanksgiving Day
- Christmas Eve
- Christmas Day
- New Year’s Day
- Independence Day
PandaTip: Many remote employees are required to travel from time to time. The template lists when such travel will be reimbursed by the employer, and details the process for requesting travel reimbursement.
The Employee shall not submit any travel costs for reimbursement without prior approval from the Employer.
Travel costs shall be reimbursed in accordance with applicable law.
The Employee shall submit a detailed travel report along with original copies of any receipts related to the travel report no later than 30 days past the travel date.
PandaTip: Most telecommuting employees are salaried, and are thus exempt from overtime pay under Federal Law. If your employee receives hourly wages you’ll want to delete this section of the template.
The Employee is considered except under Federal Law, and as a result is not eligible for overtime pay.
The Employee will be provided with any and all necessary equipment needed to perform assigned duties as described below.
Without prior notice the Employer may request to inspect the provided equipment as well as the location the equipment is located.
The following items shall be disbursed to the Employee for use during this telecommuting agreement:

The Employee agrees to accept any and all liability for damages, injury, or loss that may result from this telecommuting agreement, including loss or damage to Employer-provided equipment.
The Employer shall not be held responsible for any costs beyond the Employee’s agreed compensation package for any reason.
The Employer will offer all required workmans’ comp benefits required by [Employer.State].
Coverage should be above minimum standards and documentation of such benefits will be provided to the Employee.
PandaTip: Use this section of the template to list the job duties assigned to the employee.
The Employee will be responsible for the following duties during the term of this telecommuting agreement.

The Employee agrees to meet monthly at [Meeting.Location] as required by the Employer.
The Employee will, during that meeting, obtain all work requirements and will cover any and all meeting requirements.
The Employee will be subject to an annual performance review by the Employer.
The Employee agrees to keep all documents obtained during the term of this telecommuting agreement confidential and will not make public any information obtained about the Employer or any clients of the Employer public for any reason.
This confidentiality clause shall remain in effect for a period of 24 months after the expiration or termination of this telecommuting agreement.
Shall any legal proceedings occur from this agreement they shall take place in [Employer.State].
Any attorney fees and costs shall be covered by the prevailing party of such proceedings.
At any time during the point of this Telecommuting agreement both the Employee and the Employer may terminate this agreement without prior notice.
Upon termination the Employee shall return all materials and documents to the Employer without delay.
Any materials not able to be returned must be destroyed.
By signing below, both parties agree to all terms and conditions contained within this telecommuting agreement.
