The Parties

This month-to-month Room Rental Agreement (“Agreement”) is by and between [Tenant.FirstName][Tenant.LastName] (“Tenant”) and [Landlord.FirstName][Landlord.LastName] (“Landlord”), whereas the Tenant is the Party wishing to rent a room on the Property, and the Landlord is the Owner or Principal Tenant of the Property. The Agreement is intended to promote household harmony, as the Tenant understands and acknowledges they will be sharing a home with the Landlord or other Tenants.

Rental Unit

The Rental Unit is (Room.Description) (“Rental Unit”), facing (Direction) on the Property, (Property.Name) (“Property”). The Property is located at (Property.Address). The Rental Unit is (Number) square feet, and for the duration of this Agreement, will be considered the private premises of the Tenant.

On the Property, the following areas will be considered communal spaces, with the Tenant aware that they will share the space with the Landlord or other Tenants.

Tenant acknowledges that any spaces and rooms not listed above are private and inaccessible to the Tenant. The Tenant agrees that they will not enter any of these rooms or areas unless they are explicitly invited to by the Landlord or other Tenants.

Term

This Agreement operates on a month-to-month basis. Unless the Tenant or Landlord serves a notice of termination, the contract will automatically renew each month, with the same terms and conditions in full force and effect.

Notice of termination or a change to the terms of this Agreement from either Party requires 30 days written notice. The Parties can change the notice period with a mutual written agreement, but it can be no less than seven (7) days.

Rent

Tenant agrees to pay a monthly rental amount of $(Amount) (“Rent”) to use the Rental Unit. Rent is always due the 1st day of the month and must be made using (Payment.Method) or (Payment.Method). Should the Tenant not pay the Rent by the due date, the Landlord has the right to charge a late fee. This late fee will be $(Amount) per day/(Percentage)% per day, whichever is greater.

The Rent does/does not include utilities. Should utilities not be included, then they are calculated as follows:

Gas/Electricity:

Conflict Resolution

All disputes will be resolved in good faith using clear communication, as all housemates strive to live in harmony and cooperation. If clear communication does not resolve the conflict, the Tenant agrees to use one of the below methods:

Resolution decided by household consensus

An impartial third party mediates the disagreement

Resolution approved by household majority vote

Principal Tenant decides on a solution

The Owner decides on a solution

Tenant agrees to abide by the resolution reached using one of these methods.

Privacy

The Landlord can only enter the room of the Tenant for the following reasons:

  1. In the case of an emergency;

  2. To complete the agreed-upon requests, necessary repairs, maintenance, improvements, decorations, or any similar service;

  3. To exhibit the unit to prospective renters, purchasers, contractors, workers, or mortgagees;

  4. If the Tenant abandoned or surrendered the premises;

  5. Under a court order.

The Landlord must give twenty-four (24) hours written notice of their intention to enter the room during business hours, except in the cases of (1) and (4) above.

Deposits

Tenant is required to make the following deposits upon signing this Agreement:

Rent of last month: $(Amount) paid on (Payment.Date).

Security Deposit: $(Amount) paid on (Payment.Date).

Other Refundable Deposit: $(Amount) paid on (Payment.Date) for (Deposit.Reason).

These refundable deposits will be returned to the Tenant within (Number) days of terminating this Agreement, less any deductions. The Landlord can make deductions to pay for damages, losses, and repairs required on the room above the expected wear and tear. All deductions must be listed on an itemized statement, with a detailed calculation showing the remaining balance, which they must give to the Tenant when refunding the deposits.

Miscellaneous

Lead-Based Paint Disclosure

The Landlord acknowledges that they:

Have knowledge of lead-based paint used on the Property: (Warning.Description).

Have no knowledge of lead-based paint or lead-based hazards on the Property.

Should the Landlord know of any lead-based hazards on the Property, they will duly inform the Tenant of it, along with any possible risks it can pose.

Agreement

This document is the complete and final agreement, with no other verbal or written promises, agreements, understandings, or negotiations considered valid. Landlord and Tenant enter this agreement on the date below and acknowledge and understand that their signature below will signify their compliance with the terms and conditions of this Agreement.
