Agreement Between Parties

This Booth Rental Agreement (“Agreement”) is made on the (Date) by and between [Lessee.FirstName][Lessee.LastName] (“Lessee”) and [Lessor.FirstName][Lessor.LastName] (“Lessor”). The Lessor agrees to rent the property described in the Leased Premises section to the Lessee under all the terms and conditions outlined in this Agreement.

Leased Premises

The premises to which this Agreement relates is located at (Booth.Location). It consists of (Number) foot by (Number) foot-sized station (“Booth”). Lessee has the right to operate the Booth and provide hair styling services to the public.

Condition of Premises

Lessee agrees to accept the Booth in its current condition, with full knowledge of what that condition is, and having received the chance to inspect it before signing this Agreement.

Use of Premises

Lessee shall use the premises for the sole use of any hair cutting, styling, coloring, or any other services related to the hair salon industry. Lessee will only use the Booth under federal, state, and local laws.

They will not use nor permit any other to use the Booth in a way that violates federal, state, or local laws and regulations. Lessee and their guests, customers, employees, invitees, and agents will always comply with the rules and regulations the Lessor imposed on the Booth and in this Agreement.

Term of Agreement

This Agreement operates on a:

Fixed Term: The Agreement begins on the (Start.Date) and ends on the (End.Date).

Month-to-Month Rental Term: The Agreement begins on the (Start.Date) and continues on a month-to-month basis until either Party terminates it with a written notice at least (Number) days in advance.

Week-to-Week Rental Term: The Agreement begins on the (Start.Date) and continues on a week-to-week basis until either Party terminates it with a written notice at least (Number) days in advance.

Rental

The Rent payable under this Agreement for the use of the Booth is:

$(Amount) per month, payable on the first of each month,

$(Amount) per week, payable on (Day) of each week,

(Percentage)% of all income, less tips, generated through use of the Booth,

$(Amount) per week/month in addition to (Percentage)% of all income, less tips, generated through the use of the Booth.

Lessee will pay all Rent using (Payment.Method) or (Payment.Method). Lessee has the sole responsibility to ensure no Rent payments are late. Should the Rent be late by more than (Number) days from the required payment date, a late fee of $(Amount) or (Percentage)% interest on the outstanding balance will apply.

Security Deposit

The Lessor requires the Lessee to pay a security deposit of $(Amount) (“Security Deposit”) upon signing this Agreement. The Lessor will return this Security Deposit, less any subtractions, within 30 days of termination of this Agreement. The Lessor will detail any subtractions to the Security Deposit in a statement, with a detailed calculation of the remaining balance, which they will give to the Lessee.

Equipment and Personal Property

Lessee may equip the Booth with their equipment only with the consent of the Lessor. However, the Lessor agrees to not unreasonably withhold their consent unless said equipment or personal property disrupts the everyday business.

Maintenance

Both Parties agree that Lessee shall maintain the Booth in a clean and neat condition for the duration of the Agreement. The Lessee is responsible for maintaining the Booth and any equipment of the Lessor in the same condition as they received it, except for the expected wear and tear. It is the responsibility of the Lessee to repair any damages to the Booth or equipment at their own cost, provided the damages are caused by any act of omission or malice by the Lessee or any of their agents, customers, invitees, employees, or guests.

Lessee will make no structural changes to the Booth without the express written permission of the Lessor. At the end of this Agreement, Lessee will return the premises in as good of a condition as they received it, except for the expected normal wear and tear.

Miscellaneous

Taxes

The Lessee shall be responsible for their portion of real estate taxes associated with the Booth, provided the Lessor owns the premises and Booth and is initially responsible for these real estate taxes.

Indemnity

Lessee covenants and agrees to hold harmless the Lessor and all agents, employees, heirs, assigns, affiliates, and other associates from any loss, damage, claims, and liability to any property or person occurring on or about the premises for any cause whatsoever.

Janitorial Services

Lessor may, at their discretion, provide janitorial services to the premises for the upkeep of the Booth.

Default

Either Party shall notify the other in writing on any default, whereupon the Party shall have (Number) days to comply with the notice or vacate the premises/terminate the Agreement.

Should the Lessee refuse to vacate the premises without curing the default, the Lessee shall be liable to reimburse the Lessor for any loss of business or revenue, attorney fees, or other damages warranted through their refusal to vacate the premises.

Should the Lessor refuse to cure their default and the Lessee terminates the Agreement, the Lessor shall be liable to reimburse the Lessee for any loss of business or revenue, attorney fees, or other damages warranted through their refusal to cure the issue and the termination of the Agreement.

Subletting

The Lessee agrees not to sublet or otherwise assign a third party to this Agreement for the duration of the Agreement.

Damages to Property

Should the Premises be partially destroyed or damaged by fire or other hazards not the fault of the Lessee, the Lessor shall repair and restore the Booth as soon as reasonably possible. However, should the premises be destroyed or so damaged that the business cannot reasonably use it, then the Lessor may terminate this Agreement with written notice of (Number) days to the Lessee.

Agreement

This Booth Rental Agreementshall be governed, construed, and enforced following the laws of (State). Any changes or amendments to this Agreement must be in writing and signed by both Parties. Any disputes related to this Agreement will first be solved using binding arbitration.
