What is an Eviction Notice?

An eviction notice is an official legal document that a property manager sends to a tenant to inform them of a lease violation or the termination of the rental agreement. There are two types of infractions that may warrant an eviction notice – a curable or incurable violation.

Why do I need an eviction notice?

Landlords must send eviction notices to begin the process of properly terminating a tenancy. Most state laws require landlords to give some sort of notice before officially evicting a tenant. If the renter fails to fix the curable offense or vacate the property, property managers can then begin filing an unlawful detainer lawsuit. Be sure to check with your local county government for information regarding eviction moratoriums.

This letter serves as your official notification that, under the terms of the Lease Agreement dated and signed on (MM.DD.YYYY), the lease has been violated on the grounds of (enter lease termination reason here).

First, identify whether the violation is curable or incurable. Depending on this classification, your eviction notice form will need to include specific information.

Given lease terms and the violation of the Lease Agreement, the tenant will have (enter the time frame to allow the renter to resolve the dispute) calendar days to be in compliance with the lease. If the tenant violated a specific section of the written lease, include that section number in the reason for the lease termination. For example, “The lease has been terminated on the grounds of violation of section C.3.6b: ‘Tenant shall not allow an unauthorized animal to dwell at the rental property.

  • An eviction notice is a document that informs a tenant they must leave or be removed from the place they occupy. If the situation between tenant and landlord improves (back rent is paid up in full, for example), the notice can be retracted, but that is rarely the case once it gets to the point of an eviction notice being posted.

  • Eviction usually takes 5-10 weeks, although it could be faster or much slower (over a year) depending on the conditions. For example, when government implements a moratorium on evictions, you can’t remove tenants until it expires; in the case of a pandemic or other natural disasters, the process will also take longer.

  • To evict a tenant without going to court, you first need to send them an eviction notice within a “reasonable” timeframe, usually one payment period (e.g. 1 month if the tenant pays monthly and no other lease is in place). If done legally and after the proper waiting period, you are allowed to change the locks even with their possessions still inside.
