According to the state of Texas legislation, a landlord isn’t required to return a tenant’s security deposit or provide a written description of any damages and charges until the tenant has submitted a written notice specifying their forwarding address for the purpose of refunding the security deposit.
The Sublessee shall also pay a security deposit in the amount of $(Insert Security Deposit Amount) at the beginning of the term. This deposit is intended to cover any damages, losses, or expenses incurred by the Sublessor in restoring the Premises to its original condition, apart from reasonable wear and tear. The Sublessee acknowledges that the security deposit is not to be considered as payment of rent or as a substitute for any monthly rent obligation.
The security deposit shall be refunded to the Sublessee, without interest, upon the return of the Premises in the same condition as at the beginning of the term. The Sublessee agrees that the Sublessor may deduct from the security deposit any unpaid rent, damage repairs, or other expenses incurred during the term of this Sublease. The Sublessee shall be provided with an itemized statement of any deductions made from the security deposit within the statutory time frame as required by law.
Condition of Premises
The Sublessee shall surrender and deliver the Premises to the Sublessor upon the conclusion or expiration of the term. The Premises, including all contents, shall be returned in the same condition as it was at the beginning of the Sublessee's occupancy, except for reasonable wear and tear. The Sublessee shall be solely liable for any loss or damage that occurs during the term of this Agreement.
Incorporation of the Master Lease
This Sublease Agreement Victoria includes and refers to the Master Lease Agreement between the Sublessor and the Landlord. The Sublessee has been given a copy of the Master Lease Agreement, and it is attached hereto and considered a part of this Sublease Agreement. The Sublessee will take on all the obligations and responsibilities the Sublessor had under the Master Lease for the entire period of this Sublease Agreement.
If any legal action arises from this Sublease Agreement Victoria, the Party who successfully prevails in the case will have the right to be compensated for their reasonable attorney's fees and court costs.
