A notice of intent to vacate is a formal letter telling the property owner or manager that the tenant wishes to end the lease.

Most properties require a minimum of the 30-day notice, but some require 45 or 60 days. Always confirm by checking your state’s landlord-tenant law, as well as the lease renewal or termination clause in the actual lease you have signed with your landlord to determine.

Landlords can vary from property owners to corporations or organizations of some sort, but besides addressing the letter correctly, the contents of your notice of intent to vacate letter won’t really vary. If you are addressing the letter to a property management company instead of an individual, a salutation of “To Whom It May Concern” is appropriate.

I will not be renewing the lease, and therefore, plan to vacate the premises on or before (date of planned move).

This letter fulfills the (number of days to vacate)-day notice requirement per the lease agreement.

Keep in mind that if you’re breaking your lease early, you’ll likely be liable for penalties such as paying a month’s rent (or more), losing your security deposit, or having a negative rental reference. If there are problems with your property or if you believe your landlord has broken your lease, you may need legal assistance to figure out your next steps and to try and prevent some of these negative consequences associated with breaking your lease early.

Clarify what amount of your security deposit your lease states you should receive back. If your landlord informs you that they will be taking part of your security deposit to pay for damages, consider asking for an itemized list of all damages and deductions.

Make sure that your new address is correct and that you’ve included every essential piece of information, including a new unit number since this is where your check and any important mail will be sent. Most leases give the landlord up to 30 days to return their tenant’s security deposit, but the rules vary from state to state and lease to lease, so read your state and lease rules to get a better understanding of the security deposit return timeline.

Remember, this isn’t the final step before you move out. You’ll still need to do a walk-through of the property with the landlord to document anything that may need to be fixed or deducted from the deposit, and if you don’t hear back from your landlord about this walk-through, you’ll want to follow up to make sure it gets completed prior to moving out.
