Law Considerations

Virginia doesn’t have specific statutory disclosure requirements for room rental agreements beyond the general principles of contract law. However, the Virginia Residential Landlord Tenant Act contains provisions specifically applicable to tenants renting a room where they share common facilities like bathrooms, kitchens, or living areas.

  •  Under the law, tenants are entitled to safe and habitable accommodations. 
  • Landlords must provide heat, hot water, electricity, clean shared facilities, and comply with housing codes.
  •  Property owners must also disclose all rules regarding using common areas or restrictions up front. In return, the law requires tenants to pay rent on time, refrain from causing property damage, dispose of trash properly, and notify landlords regarding maintenance needs or safety issues. 
  • Tenants are generally responsible for keeping their rented rooms clean and tidy. 
  • The law also bars tenants from illegal activities and making any changes to the premises without permission.  

Termination

For month-to-month or weekly room rentals, the landlord or tenant can terminate the arrangement simply by providing proper advance notice. However, landlords can’t evict tenants without following formal procedures for non-payment. Property owners must provide an itemized list of any fees or damages deducted from security deposits. The law prevents them from retaliating when tenants complain about housing code violations. 

The law also contains specific rules based on the type of accommodation and length of stay. Land landlord-tenant laws generally don’t cover those staying for 90 days or less. However, longer-term tenants gain protections such as the right to proper eviction procedures.
