Security Deposit Limits

  • Deposit limits: Landlords in Nebraska can’t charge more than one (1) month’s rent as the security deposit. 
  • Return deadline: Landlords must return the security deposit within 14 days after the lease term ends. 
  • Permissible deductions: The security deposit amount can be used to offset unpaid rent, utilities, reasonable cleaning costs, and late fees
  • Late return penalty: If the deposit isn’t returned on time, the tenant can claim the deposit amount plus twice the deposit or one (1) month’s rent, court costs, and attorneys’ fees.

Eviction Procedures

    • A seven (7) day Notice to Quit for non-payment of rent, 
    • A 30-day Notice to Vacate for month-to-month tenants, 
    • A 30-day Notice to Comply or Vacate for lease violations, 
    • A 14-day Notice to Vacate for repeated violations within six months or, 
    • A five (5) day Notice to Vacate for illegal activities committed by the tenant. 
  • Filing lawsuit: After serving the appropriate notice, the landlord must file an eviction complaint in the District Court. This requires an $85 filing fee. The tenant must be served a summons within three days. 
  • Hearing and judgment: The court hearing must be scheduled 10-14 days after the summons is issued before a judicial officer with no jury trial. If the tenant fails to appear, the landlord can receive a default judgment in their favor. 
  • Repossession of premises: After receiving the writ of restitution, the tenant has up to 10 days before a sheriff or constable can forcibly remove them.  

Right To Enter

  • Notice of entry: Nebraska rental laws allow landlords to enter the premises for inspection maintenance and to show the property. They must, however, give a 24-hour advance notice:
  • Unpermitted entry: Landlords can enter your house in emergencies without giving notice. 
  • Refusal of entry: Tenants can refuse unreasonable notice of entry from the landlord. However, unreasonable refusals can result in damage claims by the landlord. 
  • Changing locks: Tenants can change the locks without notifying the landlord, but they must give them the new keys. 
  • Illegal entry: Unpermitted entry by the landlord can lead to a lawsuit resulting in lease termination or even one (1) month’s rent in damages plus attorney fees. 

Disclosures

Legally binding Nebraska lease agreement templates must have a disclosure section detailing the following: 

  • Lead-based paint: For properties built before 1978, landlords must provide the EPA pamphlet “Protect Your Family from Lead in Your Home”.  They must also disclose any known lead-based paint hazards.
