Security Deposit Limits

  • Oklahoma doesn’t set a maximum limit for security deposits.
  • A security deposit must be held in an escrow account in Oklahoma.
  • Violation of the above point is punishable by up to six (6) months in county jail and a fine of up to twice the deposit amount.
  • If the property is sold, the deposit amount should transfer to the new owner or returned to the tenant.
  • Landlords can keep part or all of the deposit to cover damages to the property and any rent owed. A tenant cannot use the deposit to pay the last rent unless agreed in the rental agreement.
  • An itemized statement covering the reasons for retaining any portion of the deposit should be sent by return receipt in the mail or delivered in person. 
  • Tenants need to write a request for the deposit to be returned.
  • After the termination of a lease and receiving the written request, landlords must return the deposit within 45 days.
  • The tenant is entitled to recover damages if the landlord fails to return the deposit in time or comply with these laws.

Eviction Procedures

When using Oklahomalease agreement templates, there are some clauses relating to the notice to quit that you can include.

  • Under Oklahoma law, notice to pay late rent is also considered a notice to quit, meaning a lease will terminate, and eviction proceedings can occur.
  • If a tenant, for less than three (3) months, is late with the rent, the landlord may send a five (5) days’ notice to quit that indicates the lease will terminate unless the specified sum is paid.
  • If a tenant, for three (3) months or more, is late with the rent, the landlord may send a 10-day notice to quit that indicates the lease will terminate unless the specified sum is paid
  • If the tenant pays rent in that time, the tenancy continues, but if they don’t pay, the agreement terminates 10 days after the notice is provided.

Right to Enter (Landlord)

Oklahoma laws set out the tenant and landlord obligations concerning the landlord’s right to enter the premises.

  • Apart from an emergency, a landlord must give the tenant one (1) day’s notice of their intent to enter the property and must not abuse their right of access.
  • Tenants should not unreasonably withhold consent for the landlord or agents to enter for necessary purposes, such as repairs. 
  • Tenants have the right to provide written notice to terminate a tenancy and recover damages following unlawful entry or unreasonable lawful entry.

Disclosures

According to the Oklahoma Statutes, landlords must share specific information with prospective tenants before entering into a rental agreement. A landlord must disclose the following:

  • Methamphetamine – If a premise was used in the manufacture of methamphetamine unless the contamination is 0.1 mcg or less per 100cm² of surface materials within the premises.
  • Flooding – If a premises has been flooded within the past five (5) years.
  • Lead-based paint – Landlords must inform tenants about any lead-based paint used in the home in residences built before 1978. A pamphlet about protection from lead hazards must be provided. 
  • Owners and managers – the names and addresses of the owners, managers, and any agencies acting on their behalf must be provided.
