Understanding Utah Rental Laws

Security Deposit Limits

  • Utah laws don’t place limits on how much lessors can ask for the security deposit.
  • Further, lessors don’t need to bear interest on the amount or keep it separate from other funds. That’s because there’s no legislation surrounding this.
  • If the security deposit is non-refundable, either in part or in full, the lessor must state this in the lease agreement.
  • The lessor has 30 days from when the lease ends to return refundable security deposits to the lessee.
  • Lessors must also include an itemized deduction statement when returning the security deposit.

Eviction Procedures

  • For most violations, the lessor must provide three (3) days of notice before starting the eviction process.
  • Valid reasons to evict a lessee are the following:
    • Non-payment of rent;
    • Subletting or assigning the property without the lessor’s permission;
    • Illegal activities on the premises;
    • Causing damage to property or allowing someone to cause damage;
    • Violating the lease’s terms.
  • If the lessee corrects the violation within three (3) days, then generally, the tenancy can continue.
  • If the lessor proceeds with the eviction, they must take it to the local courts.

Right to Enter (Landlord)

  • Lessors must provide at least 24 hours’ notice when entering the property. 
  • There aren’t many other statutory provisions regarding a lessor’s right of entry. 
  • Generally, lessors can only enter the property for valid reasons, such as repairs, maintenance, or inspections.
