Security Deposit 

  • In Idaho, there’s no limit on how much the landlord can ask as a deposit. However, a standard, reasonable amount is usually one (1) to two (2) months’ rent.
  • The security deposit cannot be used as last month’s rent in Idaho under any circumstances. It may only be used for any damages caused to the property.
  • Per Idaho’s legislation on security deposits, property owners are given a 21-day window to refund tenants’ security deposits upon departure.
    • This timeframe can be adjusted if a mutual agreement is reached between both parties, but it shouldn’t surpass a 30-day limit.
  • The security deposit must be put into an escrow account until it’s time to return it, minus any deduction. It cannot be considered as rental income.

Entry and Access 

  • As a renter, many entitlements will be shaped by the conditions of the Idaho Apartment Lease Agreement signed with the property owner. However, there are no stipulations in Idaho state laws that require landlords to provide any minimum notice.
  • Property owners can access the property without any obligatory minimum notice. As mentioned, renters can negotiate specific terms within the agreement to establish entry protocols. 
  • It’s quite typical for renters to arrange notification procedures, such as a 48-72 hour notice, with their landlords. Regardless of the situation, your landlord can legally access your home in emergencies.

Pets Policy 

A pet addendum grants the tenant the right to house pets on the leased property. It stipulates that the tenant is accountable for their pet(s), ensuring the animals are well-behaved and that they don’t cause excessive disruption on the property, and the pet owner is liable for any property damage caused by the pets.

  • Emotional Support Animals: In line with Federal law, a landlord is prohibited from imposing a pet fee if the animal serves as emotional support.
  • If the animal doesn’t serve as emotional support, the landlord can levy any desired charges unless there’s a state-imposed maximum limit.
